Following a thorough examination by officials this past year, it was concluded that the DIP system being used at the time was inadequate for the larger volume of recordals being submitted and the process was found to be inadequate for a timely process. As a result, the Department of Intellectual Property (DIP) immediately took action to streamline the process and released a new system on January 3, 2023, in order to expedite the filings.

The new system installed this past year has made it possible to help new applicants obtain the registration of the mark, whereas the old system would take eight to sixteen months to complete.

This program motivates the trademark registrar to issue the first action for the trademarks that are participating in the program within (4) months.

Upon the issuing of the first action, The Registrar will provide the initial ruling to refuse the official notice by the trademark registrar; or indicate additional action take place such as publication of a notice which means that it will not be registered within the (4) month period, and in the instances in which the trademark includes the service mark; the certification mark and collective mark are not included in that initial process.

Qualifications and related documents

  1. The application will be filed through the e-filing system in Thailand excluding the trademark application submitted through the Madrid Protocol;
  2. Specify the amount of the specification of goods in a single class not more than (10) items per class;
  3. The specification of goods based on the Thai DIP database. [http://tmsearch.ipthailand.go.th];
  4. The applicant will submit the documents in Thai language for the justification as being for a pressing need for the states trademark such as a marketing plan or purpose of using the trademark etc.
  5. The applicant will submit the new application together with their search results for identical/similar marks from the Thai DIP database [http://tmsearch.ipthailand.go.th]; TM view [http://www.tmdn.org/tmview/#/tmview] and Global Brand Database [http://branddb.wipo.int/branddb/en].
  6. The applicant does not submit any action before the trademark registrar issues the first action such as the Assignment, Inheritance rights, Change agent, New recordal the name of applicant or the address. If the applicant files any action as above the trademark registrar will examine as usual time frame (8-12) months.
